Juvenile Indicted for Murder of his Brother

In St. George, a teenager was recently indicted for a felony murder charge.  The boy, 16 year old James Tyler Sweatt was charged with murder after he allegedly shot his younger brother on October 25th.

Police say that the 15 year old pointed a 12-gauge shotgun at his 11 year old brother, Tracy Earl Sweatt, and then pulled the trigger.  The victim had been standing outside of his home when his brother pointed the gun at him and fired.

The jury presiding over the case had the choice of indicting Sweatt on charges of involuntary manslaughter.  However, they decided against that choice.  Had Sweatt have been indicted for involuntary manslaughter charges, he would have been tried as a juvenile offender.  Now, he will be tried as an adult and if he is convicted, he could be sentenced with life imprisonment.  Due to his young age, he is ineligible for the death penalty.
