Two Men Accused of Murder Make Court Appearance
This week, two men that stand accused of the murder of Bibb County Sheriff's Deputy Joseph Whitehead appeared in court Georgia Supreme Court. In March 2006, Whitehead was killed while serving a warrant in connection to drug crime charges at a Macon home.
At this time, prosecutors have made it known that they are seeking the death penalty. The defendants are Antron Fair and Damon Jolly. Fair's attorney argued that prosecutors should not seek the death penalty because the defendants did not know Whitehead was an officer. Therefore, the lawyer said the men should not be charged with killing a law enforcement officer. He also argued that the defendants had the right to defend their property with deadly force.
District Attorney Howard Simms said that whether a person knows if a victim is an officer or not, the person can still be charged with killing an officer. Simms also said that the officer had a valid search warrant and entered the home lawfully.
The Supreme Court is expected to make a decision in the next six months regarding the legitimacy of the charges.
